These Terms & Conditions explain the basic rules for using esperoart.com and the content and services available through the website.

I want this page to be clear and understandable, so I have tried to avoid unnecessary legal jargon. If you have any questions about these Terms, please contact me at chris@esperoart.com.

This website is operated by Krzysztof Kowalski (“I”, “me”, “my”).

By using this website, you agree to these Terms & Conditions. If you do not agree with them, please do not use the website.

These Terms apply to your use of the website generally. If you purchase a membership or another paid product or service, additional terms may apply to that purchase, including the Membership Terms & Conditions.

2. Changes to These Terms

I may occasionally update these Terms & Conditions, for example, if my website, services or the law changes.

When I make changes, I will update the “Last updated” date at the top of this page. If a change is significant, I may also provide additional notice where appropriate.

Your continued use of the website after the updated Terms have been published means that you accept the updated Terms.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

3. Using the Website

3.1 Age and responsibility

You must be legally permitted to use this website and enter into agreements in your country of residence.

If you are under the age required to enter into a contract where you live, you should only use the website with the involvement and permission of a parent or legal guardian.

3.2 Providing accurate information

If you create an account, purchase a product or service, or otherwise provide information to me, you agree to provide information that is accurate and up to date.

Please do not impersonate another person or use someone else’s account or personal information without permission.

Please use this website responsibly and lawfully.

  • break the law or encourage others to do so;
  • interfere with the website or attempt to gain unauthorised access to it;
  • upload or share harmful, abusive, offensive or unlawful material;
  • infringe someone else’s copyright, trademark, privacy or other rights;

  • misuse the website, its content or its services in a way that could damage the website or other users.

Your privacy is important to me.

My Privacy Policy explains how I collect, use and protect personal information.

By using the website, you acknowledge that your personal information may be handled as described in the Privacy Policy.

If you purchase a product, membership or service, additional information may be collected and processed as necessary to process your order and provide the service.

5. Copyright and Intellectual Property

Unless otherwise stated, the content on this website belongs to me or is used by me with permission.

This includes, for example:

  • paintings and artwork;
  • photographs;
  • tutorials and instructional materials;
  • written content;
  • graphics and illustrations;
  • website designs and layouts;
  • logos and branding; and
  • other original materials created for Esperoart.

This content is protected by applicable copyright and other intellectual property laws.

You may view and use the content for your own personal purposes in connection with using the website and any products or services you have purchased.

Unless I have given you permission or the law expressly allows it, you may not:

  • reproduce or republish my content;
  • copy or redistribute tutorials or instructional materials;
  • upload my content to another website or platform;
  • sell, license or commercially exploit my content;
  • claim my work as your own; or
  • use my content to create or train another commercial product or service.

Purchasing a product, tutorial or membership gives you the rights specifically described for that product or service. It does not transfer ownership of my copyright or other intellectual property to you.

Some content on the website may belong to third parties. Where this is the case, the rights of those third parties remain unaffected.

6. Your Artwork and Giving Credit

One of the things I love most about teaching art is seeing students take what they learn and create their own artwork.

If you create a painting after following one of my tutorials, you retain the rights you have in the artwork you create, subject to any rights belonging to third parties whose materials or reference images are involved.

Following one of my tutorials or learning a technique from me does not by itself transfer ownership of your artwork to me.

You are welcome to share photographs of your finished paintings online and, where appropriate, sell your own original paintings or reproductions of your artwork, subject to any applicable third-party rights and the specific terms of any reference material used.

A friendly request about credit

I do not require you to give me credit every time you share or sell artwork inspired by my tutorials.

However, I really appreciate it when you mention that the painting was created after following one of my tutorials. It helps other artists find my work and supports my ability to continue creating new tutorials.

For example, you could say:

“Painted following a tutorial by Esperoart.”

or:

“This painting was inspired by a tutorial by Krzysztof Kowalski / Chris / Esperoart.”

You can also tag or mention Esperoart on social media when appropriate.

This credit is appreciated but voluntary, unless a particular product or third-party material expressly states otherwise.

Please also keep in mind that some art competitions, exhibitions or other events may have their own rules about artwork created from tutorials or reference materials. It is your responsibility to check those rules before entering.

7. Third-Party Content and Links

The website may contain links to or information about third-party websites, products, services or resources.

These third-party services are not controlled by me, and I am not responsible for their content, availability, privacy practices or terms.

If you choose to use a third-party service through a link on my website, you do so according to that third party’s own terms and policies.

Where I recommend products, materials, websites or other services, I may receive a commission or other benefit from some recommendations. Any applicable affiliate relationships will be disclosed where required.

8. Website Availability and Changes

I do my best to keep Esperoart available and working properly, but I cannot guarantee that the website will always be available, uninterrupted or completely error-free.

I may occasionally need to:

  • update, modify or improve the website;
  • add or remove features;
  • temporarily suspend access for maintenance;
  • change or discontinue particular content or services.

I will try to provide reasonable notice where appropriate, particularly where a change significantly affects a paid service.

Nothing in these Terms affects any rights you may have under applicable consumer protection law.

9. Educational Content and No Guarantee of Results

Esperoart provides educational and creative content intended to help you learn and develop your artistic skills.

However, everyone’s experience, materials, artistic ability and results are different. I cannot guarantee that you will achieve a particular artistic result by following a tutorial, using a recommended material or applying information provided on the website.

Any examples, photographs, demonstrations or testimonials are intended to illustrate possibilities and are not guarantees of a particular result.

Where I recommend products, art materials or other third-party services, these recommendations are based on my experience or the information available to me. I cannot guarantee the performance, availability or suitability of products supplied by third parties.

10. Limitation of Liability

I provide this website and its content with reasonable care, but to the extent permitted by applicable law, I am not responsible for losses that arise solely from:

  • your misuse of the website;
  • your failure to follow instructions or applicable laws;
  • your use of third-party products, services or websites; or
  • circumstances outside my reasonable control.

However, nothing in these Terms excludes or limits liability where doing so would not be permitted by law, including any mandatory rights or protections you have as a consumer.

If you are a consumer, nothing in these Terms is intended to remove or restrict your statutory consumer rights.

If you are a consumer, you have rights under the consumer protection laws that apply to your purchase or use of the website. Nothing in these Terms is intended to limit those rights.

I will always do my best to resolve issues fairly and reasonably.

For purchases made online, statutory consumer rights may include a right to withdraw from a distance contract. The exact rules and any applicable exceptions depend on the type of product or service involved.

12. Governing Law

These Terms are governed by the laws of Poland, unless mandatory consumer protection laws in your country of residence provide otherwise.

If you are a consumer, you will continue to benefit from any mandatory protections that apply to you under the law.
