Membership Terms & Conditions

These Membership Terms & Conditions explain how the Esperoart Membership works, including access, payments, subscriptions, cancellations, refunds and the use of membership content.
By completing a Membership purchase, you agree to these Terms & Conditions.

1. Membership
1.1 What your Membership includes
Your Membership gives you access to the content and services described on the Membership page and at the time you sign up.
Depending on the Membership you purchase, this may include:
- video painting tutorials;
- reference photographs;
- material and supply lists;
- newsletters and other educational content;
- access to a private Facebook group; and
- other resources made available to members.
The specific content and benefits included with your Membership may change over time as I add new tutorials and resources.
1.2 Personal use
Your Membership is intended for your personal, non-commercial use.
Your Membership account is for you only. Please do not share your login details or allow other people to access your Membership through your account.
1.3 Personal feedback
Membership may include opportunities to ask questions or receive feedback. However, personal feedback is not guaranteed unless it is specifically stated as part of the Membership you purchased.
1.4 Changes to content and services
I may occasionally need to change, replace or remove particular content or services.
For example, a particular resource may become unavailable because of circumstances outside my control, or I may replace it with another resource of comparable value.
I will make reasonable efforts to ensure that the overall Membership continues to provide the benefits described when you sign up.
If a significant change affects your Membership, I will provide notice where appropriate.
1.5 Additional products and services
From time to time, I may offer additional tutorials, products or services that are not included in your Membership.
If something requires an additional payment, this will be clearly stated before you purchase it.
1.6 How long you have access
Your Membership remains active while your subscription is active and your payments are up to date.
When your Membership ends, your access to members-only content and services will normally end as well.
2. Subscription and Automatic Renewal
2.1 Subscription period
The Membership is a recurring subscription that renews automatically every 30 days, unless you cancel it.
Your first 30-day period begins on the date you sign up.
Each subsequent billing period covers another 30 days.
2.2 Automatic renewal
By purchasing a recurring Membership, you authorise the applicable payment provider to charge your selected payment method for each new 30-day billing period until you cancel your Membership.
The price applicable to your subscription will be shown before you complete your purchase.
2.3 Failed payments
If a scheduled payment cannot be completed, I may temporarily suspend your Membership access until the payment is successfully processed.
If payment continues to fail, your Membership may be cancelled.
I may send you an email about a failed payment so that you have an opportunity to update your payment information.
3. Cancelling Your Membership
You can cancel your Membership at any time.
Depending on how you originally subscribed, you may be able to cancel through:
- your Esperoart Membership account;
- PayPal;
- Stripe; or
- by contacting me at chris@esperoart.com.
3.1 When cancellation takes effect
Cancelling your subscription stops future automatic renewals.
Unless otherwise required by law or agreed with you, cancellation does not normally end your access immediately. You can continue using your Membership until the end of the period you have already paid for.
No further recurring payments should be taken after the cancellation has taken effect.
4. Payments and Prices
4.1 Payment
You agree to pay the price displayed when you purchase your Membership.
You are responsible for providing accurate and up-to-date billing and payment information.
4.2 Payment processing
Payments may be processed by third-party payment providers such as PayPal or Stripe.
Your payment information is handled by the applicable payment provider according to its own terms and privacy policy. I do not need to have access to your full payment card details to process your Membership.
4.3 Price changes
I may change the price of the Membership in the future.
If a price change affects your existing subscription, I will provide advance notice before the new price applies, where required by law.
You can cancel your Membership before the new price takes effect if you do not wish to continue at the new price.
4.4 Membership cannot be transferred
Your Membership is personal to you and cannot be sold, transferred or given to another person.
5. Refunds and Your Right to Withdraw
I want you to be happy with your Membership, so I offer a 7-day refund policy as described below.
5.1 Voluntary 7-day refund
If you are not satisfied with your Membership, you may request a refund within 7 days of your purchase by contacting me at:
This 7-day refund policy is a voluntary refund policy offered by Esperoart. It does not replace or limit any statutory consumer rights you may have.
5.2 Statutory consumer rights
If you are a consumer, you may have a statutory right to withdraw from an online contract within 14 days, subject to applicable legal exceptions.
Different rules may apply depending on whether your Membership involves digital content, digital services or other services.
Nothing in these Terms is intended to remove or restrict any mandatory consumer rights that apply to you.
5.3 Immediate access to Membership content
Your Membership may give you immediate access to digital content and services, including video tutorials and other online resources.
If the law requires your express consent or acknowledgement before access is provided during the statutory withdrawal period, I will provide the appropriate information and obtain the required consent through the checkout process.
Your statutory consumer rights will apply according to the law applicable to your purchase.
6. Intellectual Property
All Esperoart tutorials, videos, reference materials, photographs, written materials, graphics and other Membership content are owned by Esperoart or the relevant copyright owner and are protected by applicable intellectual property laws.
Your Membership gives you permission to access and use the Membership content for your own personal learning.
It does not transfer copyright or ownership of the Membership content to you.
You may not:
- copy or redistribute entire tutorials;
- download or share Membership content unless downloading is specifically permitted;
- share your Membership login with another person;
- upload Membership videos or other materials to another website or platform;
- sell or sublicense Membership content;
- reproduce or commercially exploit my tutorials or other Membership materials; or
- make the Membership content available to people who are not authorised members.
These restrictions do not prevent you from exercising rights that are granted to you under applicable law.
7. Your Artwork
One of the main purposes of Esperoart Membership is to help you create your own artwork.
You retain the rights you have in artwork that you create yourself, subject to any rights belonging to third parties.
Following one of my tutorials or using a technique demonstrated in a tutorial does not by itself transfer ownership of your artwork to Esperoart.
However, your artwork may also involve third-party materials, such as reference photographs. In those cases, you must respect the copyright and other rights belonging to the relevant third party.
7.1 Reference photographs
Some reference photographs used in Esperoart tutorials may have been obtained from third-party sources, including websites that provide photographs under licences such as CC0.
The copyright and other rights in those photographs belong to their respective creators or rights holders unless the applicable licence provides otherwise.
You should check the licence and any applicable restrictions before using a particular reference photograph for purposes beyond following the tutorial.
7.2 Sharing and selling your artwork
You are welcome to share photographs of your finished paintings online.
You may also sell your original paintings or make reproductions of your own artwork, provided that doing so does not infringe the rights of third parties or violate the terms of any applicable reference-image licence.
If your artwork is based closely on a particular reference photograph, you are responsible for making sure that your intended use is permitted.

8. Educational Content and Results
Esperoart Membership provides educational content intended to help you develop your artistic skills.
However, everyone’s experience and results will be different.
I cannot guarantee that following a particular tutorial will produce a specific artistic result.
Your results may depend on factors including your experience, materials, techniques and the amount of time you spend practising.
Testimonials and examples of student artwork are intended to illustrate individual experiences and possibilities. They are not guarantees that you will achieve the same results.
9. Third-Party Products and Services
Esperoart may recommend art supplies, products, websites or other services that are provided by third parties.
These recommendations are provided for informational purposes and are based on my experience or the information available to me.
I am not responsible for the quality, availability, performance or suitability of products or services provided by third parties.
Where I use affiliate links or otherwise receive a commission from a recommendation, this will be disclosed where required.
10. Limitation of Liability
I provide Esperoart Membership with reasonable care, but I cannot guarantee that the Membership or every individual piece of content will always be available, uninterrupted or completely error-free.
To the extent permitted by applicable law, I am not responsible for losses that arise solely from:
- your misuse of the Membership;
- your failure to follow applicable instructions or laws;
- your use of third-party products or services; or
- circumstances outside my reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
If you are a consumer, nothing in these Terms is intended to remove or restrict your mandatory statutory rights or consumer protections.
11. Changes to the Membership
I may occasionally update or improve the Membership, including adding new tutorials, resources or features.
I may also need to change or discontinue particular features or services.
If a significant change substantially affects the Membership you have purchased, I will provide reasonable notice where appropriate.
12. Ending a Membership
Your Membership may end if:
- you cancel your subscription;
- you fail to make required payments and the payment cannot be successfully completed;
- you seriously or repeatedly breach these Terms; or
- the Membership is discontinued.
If I discontinue the Membership entirely, I will provide reasonable advance notice where possible.
Ending your Membership does not affect rights or obligations that arose before the Membership ended.
13. Consumer Rights and Complaints
If you are a consumer, you have rights under the consumer protection laws applicable to your purchase.
Nothing in these Terms is intended to limit those rights.

14. Governing Law
These Terms are governed by the laws of Poland, unless mandatory consumer protection laws in your country of residence provide otherwise.
If you are a consumer, you will continue to benefit from any mandatory protections that apply to you under the law.
15. Entire Agreement
These Membership Terms & Conditions, together with the general Terms & Conditions and any other terms specifically presented to you when you purchase a Membership, form the agreement between you and Esperoart concerning your Membership.
If there is a conflict between these Membership Terms and the general Terms & Conditions, the Membership Terms will apply to matters specifically relating to your Membership.
