By clicking “Sign Up,” entering your payment details, or otherwise enrolling in any program, service, or product on Krzysztof Kowalski’s (Chris’) website (“Membership”), you (“Member”) agree to be legally bound by the following terms and conditions. This agreement is between you and Krzysztof Kowalski (“Owner” or “Company”).

1. Membership Terms

1.1. Upon purchase, Members receive access to the specific services or content listed at the time of purchase. These may include but are not limited to: video tutorials, newsletters, reference photos, material lists, and access to a private Facebook group.

1.2. Membership is for personal, non-commercial use only.

1.3. Direct feedback from Krzysztof Kowalski is not guaranteed.

1.4. The Owner may substitute any service or content with something of equal or greater value if reasonably necessary.

1.5. Additional content or services may be offered for an additional fee.

1.6. Membership access continues as long as the subscription remains active and payments are up to date.

1.7. Failure to make payment may result in cancellation of access without notice. If a payment fails twice, the subscription will be canceled.

1.8. If the Membership platform is discontinued, Members will receive at least 60 days’ notice.

1.9. Members may cancel their subscription anytime via email, their PayPal/Stripe account, or the Membership dashboard. Cancellation becomes effective at the next billing cycle.

2. Intellectual Property & Usage Rights

2.1. All video tutorials, reference materials, and other content remain the intellectual property of Krzysztof Kowalski. No ownership is transferred to the Member.

2.2. Student artworks created using Krzysztof’s tutorials or reference photos are considered derivative works. The original copyright remains with Krzysztof Kowalski or the original photographer.

2.3. Students may share photos of their completed paintings online, provided they follow point 6. Sharing and Giving Credit (A Friendly Note) described in the Terms and Conditions.

2.4. Students may sell their original paintings made from Krzysztof’s tutorials (e.g., at local art fairs), or reproduce them commercially (e.g., as prints), so long as they comply with the point 6. Sharing and Giving Credit (A Friendly Note) described in the Terms and Conditions.

2.5. Some reference photos may be sourced from websites such as Pixabay or Paint My Photo under the CC0 license. Copyright for such content belongs to the original photographer.

3. Payments

3.1. By enrolling, you agree to pay the full amount shown during checkout.

3.2. You agree to provide accurate, complete billing information and keep it updated.

3.3. If inaccurate or incomplete billing information is provided, the Company may suspend or terminate your account.

3.4. Credit card or PayPal charges will occur automatically on your renewal date.

3.5. Your membership rights may not be transferred or shared with others.

3.6. The Company may change pricing or add new fees with advance notice via email.

3.7. Refunds are available upon request within 7 days of purchase. After 7 days, refunds are at the discretion of the Owner.

4. Subscription & Renewal

4.1. Memberships renew automatically every 30 days from the original signup date.

4.2. Billing occurs on a rolling 30-day cycle based on your initial payment date (e.g., if you sign up on March 17, renewals will occur on April 17, May 17, etc.).

5. Cancellation

5.1. You may cancel your membership at any time.

5.2. Cancellations can be done through your membership dashboard, your PayPal or Stripe account, or by emailing: chris@esperoart.com.

6. Refund Policy

6.1. A full refund will be issued if requested within 7 days of purchase.

6.2. Refunds requested after 7 days will be reviewed case by case at the Owner’s discretion.

7. Disclaimers

7.1. The Membership does not guarantee any specific results or improvements in artistic skill.

7.2. Testimonials are for illustrative purposes only and do not guarantee the same outcomes for all Members.

7.3. Any product or third-party service recommended is shared for convenience. The Company is not responsible for any consequences of their use. If affiliate links are used, Members will be informed.

8. Limitation of Liability

You accept full responsibility for any outcomes—positive or negative—resulting from your use of the Membership. Krzysztof Kowalski is not liable for any direct, indirect, incidental, or consequential damages arising from your participation.

10. Entire Agreement

This document constitutes the full agreement between the Member and Krzysztof Kowalski, superseding any prior written or verbal agreements.
